Board at the Criminal History Systems Board that an individual on the registry has been classified as a Level 3 offender. A Level 3 offender is someone for whom re-offense is considered high.
Pursuant to Massachusetts General Laws Chapter Six, Chapters 178C-178P, the state Sex Offender Registry Board has identified, Nelson Delgado, Homeless, Lowell, as a Level 3 Sex Offender. The charge for which he was convicted or adjudicated was Open and Gross Lewdness and Lascivious Behavior on 3/28/1990, 2 counts of Indecent Assault and Battery on Child Under 14 years, Open and Gross Lewdness and Lascivious Behavior 9/2/1999.
The Board has determined that this individual is at a high risk to re-offend and that the degree of dangerousness posed to the public is such that a substantial public safety interest is served by active community notification.
